The purpose of this Privacy Notice (the “Notice”) is to describe what Personal Information (as defined below) and other information RE/MAX, LLC (collectively “RE/MAX”, “us,” “our,” or “we”) may collect from you when you visit this website (“Site”), how we may collect it, with whom we may share it, as well as the choices you have regarding our collection of information and our use and disclosure of that information to other parties. We have made our Privacy Notice (“Notice”) easy to navigate and understand by using plain English. We strongly urge you to read this Notice from beginning to end.

Overview and Scope
RE/MAX believes that you should always know what data we collect from you, how we use it, and that you should have meaningful control over both. This Notice describes how we use Personal Information, with whom we share it, your rights and choices, and how you can contact us about our privacy practices.
Changes to this Notice
It is our policy to post any changes we make to this Notice on this page. The date this Notice was last revised is identified on the top of this page. Your continued use of the Site following the posting of a revised Notice means that you accept and agree to the changes.
Personal information we collect
“Personal Information” is information about an identifiable individual, such as their name, mailing address, email address, or phone number, whether used alone, or when combined with other personal or identifying information which is linked or linkable to a specific individual. We collect Personal Information and other data from you to improve the Site and services we offer, and to tell you about products and services that may be of interest to you.
When you register or sign up for our services
Through the Site, you may create an account to save searches, sign up for alerts, access our real estate resources, and for other features we may add from time to time (“Account”). If you register for an Account, we collect Personal Information such as your first and last name, email, user name, password and any other Personal Information required on the registration form. If you wish, you may provide us your phone number and a zip code. We use this information to provide information you have requested, manage and correspond with you about your Account, send you information and newsletters related to real estate markets and/or other information we think may interest you, and for other matters described in this Notice.
Through the Site, you may choose to have us provide your email address or other contact information to an independent RE/MAX sales associate so he or she can assist you with your real estate needs. Sales associates are independent contractors of RE/MAX brokerages, which are, in turn, independently owned and operated business. We cannot control how these independent sales associates or the independently owned and operated RE/MAX brokerages use your information, and therefore this Notice does not apply to their use of your Personal Information. Please contact the sales associate or brokerage directly or follow the links included in the communications you receive from the sales associate to learn more about their privacy practices.
Information we automatically collect on this Site
The Site uses cookies, which are small, commonly-used files that are transferred to your computer by us or a third party when you allow your browser to accept cookies. Similarly, we or our third-party service providers/advertisers may also use “web beacons,” “pixel tags” or other tracking technologies, which are typically small pieces of code placed on a web page to monitor behavior and collect certain data regarding the actions of our guests online.
These cookies and other technologies may be used to track across time and sites. For example, these technologies can be used to analyze your online traffic patterns, to enhance your experience when using the Site, to store information during your session, to personalize the Site for you based on your preferences and selections, to target advertising or content to you (as described further below) and to collect information about you and your visit to the Site for other marketing and business purposes. You can adjust your privacy preferences regarding the use of cookies and similar technologies through your browser. However, disabling cookies may impair your user experience and disable certain features of the Site.
Data about your activities online may be collected for use in providing advertising tailored to your individual interests, either by us, or third parties. We may work with third parties such as network advertisers and ad exchanges to serve advertisements across the internet and may use third party analytics service providers to evaluate and provide us and/or third parties with information about the use of these ads on third party websites and viewing of ads and of our content.
We and these third-party vendors, including Google, may use third-party technologies (such as a Facebook Custom Audience Pixel) together with our own first party technologies in order to analyze ad impressions, your use of ad services, and interactions with these ad impressions and ad services. The information collected may also include information about your visits to the Sites, include the pages you have viewed and what content you have seen. These third-party tracking technologies may be set to, among other things: (a) help deliver advertisements to you that you might be interested in; (b) prevent you from seeing the same advertisements too many times; and (c) understand the effectiveness of the advertisements that have been delivered to you.

IP addresses and click-stream data
The Site and servers may collect other information from you when you access the Site, including your IP address and the pages you visited and content you viewed while on the Site. The Information collected cannot typically be used to identify you personally. However, if you have registered on the Site, it may be possible for us to link certain information to information that identifies you personally. Information collected through the Site includes information sent to us automatically by your web browser, the address of the web page you were visiting when you accessed the Site, information about your operating system, the browser you are using, the date and time of your visit, and online traffic patterns and content accessed throughout the Site.
If you contact us through the Site
When you contact us with questions about our services, our business, or other matters, we will use any information you provided us, including your name, email, phone, and residence information to resolve your request or answer your inquiry, or to provide additional information related to that inquiry. We may also place you on our marketing list for information related to your inquiry or which we otherwise believe would be of interest to you, and we may otherwise use your information as described in this Notice. You will always have the opportunity to opt-out of receiving communications by following the instructions provided in our communication.
How we use your Personal Information
We use Personal Information to:
respond to inquiries or service requests and monitor such responses;
provide information about and market our products or services or those of the RE/MAX franchise network of independently owned offices and their affiliated independent real estate agents;
resolve problems;
manage the Services and assess usage;
enhance or personalize your experience using our Services;
inform you of offers or new features that we believe may be of interest to you;
provide information or services you have requested;
process or maintain your subscription to a newsletter or mailing list;
facilitate various programs, promotions or contests in which you participate;
target advertising or content, or for other advertising, promotional or marketing purposes;
study the use and popularity of various areas of our Services and to improve our Services; and
analyze general locations where our content is viewed (by reviewing IP addresses). We may also use such information for other purposes related to our business or that of our related entities, as well as for any other purpose described in this Notice or any other agreement you may enter with RE/MAX or otherwise as we may disclose to you or to which you consent from time to time.
Legal basis for collecting and using Personal Information
We only use your Personal Information for the purposes set forth in this Notice and based on the following legal grounds:
your consent (as permitted by applicable law);
to carry out the performance of a contract or because you have asked us to take steps in order to enter into a contract;
our legitimate business interests, including:
managing our relationship with you;
managing our relationship with franchisees;
direct marketing;
product development and enhancement;
fraud and financial crime detection and prevention;
information, system, network, and cyber security;
general corporate operations and due diligence;
to comply with a legal obligation and/or defend against legal claims;
to protect a vital interest of the individual; and
to perform a task carried out in the public interest or in the exercise of official authority.
How we share Personal Information
We do not sell or rent Personal Information to marketers or unaffiliated third parties. We only share your Personal Information as follows:
Generally
Personal Information we collect may be shared with a variety of parties, depending upon the purpose for and context in which that information was provided. For example, when you search for a property, we will redirect you to the site of an independently owned and operated RE/MAX franchise office and provide information you have submitted to us, including the parameters of the search, and if you have registered, we may provide your contact information to that office. If you request to be contacted by a RE/MAX sales associate, we will disclose the Personal Information you provide to the sales associate in order to satisfy your request.
Anonymized information
We may share analyses of our server logs, traffic, or information relating to customer leads, including details regarding usage of the Site and general information about our audience, with current or potential advertisers or business partners. Such disclosures typically aggregate usage data from these analyses and other information not generally considered to be Personal Information.
Service providers
We may share Personal Information and other data with service providers who provide certain services on our behalf such as data hosting or processing services, and payment processors. These service providers may need to access Personal Information to perform their services. We authorize such service providers to use or disclose the Personal Information only as necessary to perform services on our behalf or comply with legal requirements. We require these service providers to contractually commit to protect the security and confidentiality of Personal Information they process on our behalf.
Business partners
We may share Personal Information with third party business partners when this is necessary to provide our Services to our users.
Corporate Transactions
In addition, in the event that we go through a business transition, such as a merger, acquisition, liquidation or sale of all or a portion of our assets, Personal Information will, in most instances, be part of the assets transferred, or may be disclosed (subject to confidentiality restrictions) during the due diligence process. If such a transfer occurs, the acquiring company’s use of your Personal Information will still be subject to this Notice and the privacy choices you have made.
Legal disclosures
Finally, we may share your Personal Information, any communications sent or received by you, and any other information that we may have about you as may be permitted or as we believe in good faith may be reasonably necessary to comply with any law, regulation, rule or court order; pursuant to subpoenas or other lawful requests from governmental, regulatory or administrative agencies or law enforcement authorities (including in response to law enforcement or national security requirements); to respond to any claims, or to prevent, investigate, identify persons or organizations potentially involved in, or take any action regarding suspected fraud, violations of our Terms of Use, or activity that appears to us to be illegal or we believe may expose us to legal liability. Additionally, we may disclose Personal Information in situations that we believe to be emergencies involving potential threats to the physical safety of any person or property, if we believe that your information in any way relates to that threat.
Your rights and choices
You have choices regarding our use and disclosure of your Personal Information:
Electronic communications
If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails. We will try to comply with your request as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with our services.
Your Account
If you created a profile on one of the Site, you can always access your Personal Information by logging into your Account. If you have trouble or you need further assistance with accessing your Account, or deleting your Account, you may contact us at ecare@remax.com.
Your data protection rights
Depending on your location and subject to applicable law, you may have the following rights with regards to the Personal Information you shared with us:
The right to request confirmation of whether we process Personal Information relating to you, and if so, to request a copy of that Personal Information;
The right to request that we rectify or update Personal Information that is inaccurate, incomplete or outdated;
The right to request that we erase your Personal Information in certain circumstances provided by law;
The right to request that we restrict the use of your Personal Information in certain circumstances; for example, while we consider a request to update your Personal Information;
The right to request that we sent to another company, where technically feasible, your Personal Information;
The right to withdraw consent to processing your Personal Information that you previously gave; and
The right to object to the processing of your Personal Information under certain circumstances.
In order to exercise these rights, you may contact us as described in the Contact Us section below. We will comply with your request to the extent required by applicable law. If you feel that you have no received a satisfactory response from us, you may consult with the data protection authority in your country.
Information security
We understand that the security of your Personal Information is important. For this reason, we maintain organizational, physical, and technical security arrangements designed to protect Personal Information within our organization against unauthorized access, destruction, loss, alteration or misuse. We periodically review our security measures and update them accordingly. Unfortunately, despite our best efforts, no data transmission or storage can be guaranteed to be 100% secured.
Personal information retention
We will only retain your Personal Information for as long as necessary to fulfill the purposes for which we collected your Personal Information, unless a longer retention period is required or permitted by law.
Children
The Services are not intended or directed to children under the age of 18, and we do not knowingly collect Personal Information relating to children or track their use of the Site.
International Data Transfer
We are a global business. Personal Information may be accessed, stored and processed in a country where we have operations or where we engaged service providers. This means that we may transfer Personal Information that we maintain about you to recipients in countries other than the country in which the Personal Information was originally collected, including European Economic Area, Switzerland, or the United States. The data protection and privacy laws in those countries may offer a lower level of protection than the data protection and privacy laws of your country.
If you are located in the European Economic Area or Switzerland, we comply with applicable laws to provide an adequate level of data protection for the transfer of your Personal Information to the United States. RE/MAX is certified under the EU-U.S. and the Swiss-U.S. Privacy Shield Framework and adheres to the Privacy Shield Principles of notice, choice, accountability for onward transfer, security, data integrity and purpose limitation, access, and recourse/enforcement/liability, and to the extent applicable, the supplemental principles. We encourage you to contact us if you have any concerns about our compliance with the Privacy Shield. Any questions or concerns should be sent to privacy@remax.com. We will respond to complaints related to the Privacy Shield within 45 days. If a complaint cannot be resolved informally, we have agreed to participate in the JAMS dispute resolution procedures pursuant to the Privacy Shield principles. EEA and Switzerland residents with unresolved complaints may refer them to JAMS as described at https://www.jamsadr.com/file-an-eu-us-privacy-shield-or-safe-harbor-claim. Under certain circumstances, these dispute resolution processes may result in your ability to invoke binding arbitration.
